Code of Ethics

A Court-Appointed Realtor is an active Realtor who has an expanded duty to the Court, over and above their fiduciary duty defined by Washington’s RCW 18.86.120 and the ethical standards set forth by the National Association of Realtors.

Zach Entwistle was a pioneer as the first Certified Divorce Real Estate Expert in WA. He has created his own Code of Ethics for his own practice that he and his team abide by when assigned in any law case involving real property.

Neutrality

We are an independent, third party with no vested interest in the outcome for either side. Further, we will not represent one party in another transaction during the listing and sales process.

No Kickbacks

We do not give or receive referral fees or kickbacks with attorneys representing our clients.

Restraining Order

We maintain protocols for restrained out-spouses to help prevent them from violating the orders.

Confidentiality

We fiercely protect all contact information from the public (such as phone numbers, email addresses, schedules, or personal circumstances that arise), even beyond the life of the transaction.

No Dual Agency

We do not engage in dual agency, which means that we do not represent buyers in our listings. This applies to every member of our team. Our duty will be to the seller(s) only.

No Acquiring

We'll never seek to acquire any vested interest in the purchase of divorce, power of attorney,
conservatorship, estate, and trust listings that we are professionally involved with for personal or investment purposes.

FAQs

  • By having more experience in divorce listings than probably any other agent in the WA state, my team will often identify problems a mile ahead. Very simple things, such as our intake process and showing coordination, keep a listing on its tracks, whereas applying regular listing practices almost always complicates and delays a situation.

  • Yes, I was selected to be a member of the first class of students to go through the rigorous 12 month training program to become a Certified Divorce Real Estate Expert (CDRE). That was 5 years ago. I continue to attend trainings and help mentor newer CDREs to help them serve the Family Law community at the highest level.

  • That is up to you. Working with our team, we assume there is no communication between you and your ex, so it's not necessary. We communicate with each of you separately, ensuring you have the space to be transparent and heard, while keeping you both equally informed about the process, the status, and what to expect in the next step.

  • Yes. We know that good communication means efficiency and can keep fees under control. There are five points in time that we email the attorneys in the case so that they’re aware of what’s going on, including sharing a copy of the closing statement and ensuring that we have the most current court order. Our intent is to keep attorney involvement to a bare minimum; however, we do reach out when we need clarification on something, or if despite our best efforts, we reach an impasse.

  • We take specific steps to help ensure you and your ex will not be together throughout preparing and selling your home. For instance, we never schedule clients on the same day at the same place so you can’t meet accidentally. This helps prevent the restraining order from being violated. We are also aware restraining orders can be issued after I get involved so we are always preparing for that situation.

  • No. Since we serve those going through divorce, we are appointed to all types of cases that go through the court system. We have listed homes from those that are uninhabitable, to luxury homes in the Puget Sound’s elite neighborhoods, and everything in between. All require a unique approach, and our broad experience can accommodate any and all neighborhoods.

  • Yes. We have a commercial affiliate with whom we co-list vacant land and commercial properties.

  • We can after the sale is over. We want to complete divorce sale before entering personal relationships with any parties.

  • Yes and yes. We assume, worst case, every case could end up in court so we start preparing for trial from when we are connected to the case. As a result, I am happy to court to testify even though that rarely ever happens.

  • We serve the greater Puget Sound area including South King County, North Thurston County, South Kitsap County, and all of Pierce County. We also have a network of experts throughout the state and the nation should you have a property located outside of our service area.
